Mar 22, 2016- A federal judge in the U. S. District Court for the Eastern District of New York, ordered Pfizer to pay $100 million to resolve allegations that it marketed prescription medicines for uses not approved by the Food and Drug Administration (FDA) that are covered by the Act.
In December 2013, a panel of a federal grand jury in Philadelphia, investigating allegations that Pfizer marketed certain drugs for off-label uses, including the antiviral drug valacyclovir, which was also sold under the brand name Valtrex.
The FDA denied the allegations and Pfizer settled the allegations. The FDA also dismissed a civil lawsuit filed by a former employee of Pfizer alleging that it marketed valacyclovir, which the FDA previously granted only in the context of a limited number of cases.
Pfizer was represented by its current counsel, Robert A. Hutter, Esq. in Philadelphia.
The FDA had been considering the allegations of a multidistrict litigation (MDL) filed by the plaintiffs against Pfizer, the pharmaceutical giant, and various defendants in the MDL. The MDL alleges that Pfizer marketed Valtrex, an antiviral medication used in the treatment of cold sores. The FDA, in turn, has granted Valtrex the exclusive marketing rights to the drug.
Hutter, who represented Hutter for 12 years, represented Pfizer in several cases.
Pfizer, in turn, has paid millions of dollars in settlements and has sought to use its marketing efforts to cover a substantial part of the settlement. In December 2013, the plaintiffs sought to recover $100 million in damages for alleged violations of the Act, including violations of the False Claims Act, the FDA's duty to ensure compliance with FDA regulations, the liability of federal government officials under the False Claims Act, and civil rights violations.
In December 2013, a Pennsylvania federal judge, after a federal jury trial in Philadelphia, ordered Pfizer to pay the plaintiffs $100 million for alleged violations of the Act. The judge dismissed the allegations against Pfizer and the defendants and denied their motion for a€1 million-plus award of punitive damages.
